These Terms of Service ("Terms") govern your access to and use of march.tech and the March marketing campaign management platform (the "Service").
March is operated by Gehrig Kunz, a sole proprietor based in Arizona, United States ("March," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to these Terms.
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your information.
1. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
You agree to:
- Provide accurate and complete account information
- Keep your login credentials secure
- Notify us of any unauthorized access to your account
You are responsible for all activity that occurs under your account.
2. Description of the Service
March is a marketing campaign coordination platform that allows users to:
- Plan and manage campaigns
- Track activities and timelines
- Store content drafts and briefs
- Generate AI-assisted outputs
We may modify, improve, suspend, or discontinue parts of the Service at any time.
3. User Content
You retain ownership of content you create, upload, or store in the Service ("User Content").
By using the Service, you grant March a non-exclusive, worldwide license to host, store, process, reproduce, and display your User Content solely for the purpose of operating and improving the Service.
You represent and warrant that:
- You have the necessary rights to use and upload your User Content
- Your User Content does not violate any law or third-party rights
Our handling of personal information is described in the Privacy Policy.
4. AI-Generated Content
The Service may use third-party AI providers to generate content, suggestions, or analysis.
AI-generated outputs:
- May be inaccurate, incomplete, or outdated
- May not be unique
- May resemble content generated for other users
You are solely responsible for reviewing, editing, and approving AI-generated outputs before publishing, distributing, or relying on them.
March makes no representations regarding the accuracy, originality, legality, or fitness of AI-generated content and is not responsible for consequences arising from its use.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe intellectual property or privacy rights
- Upload malicious code or attempt to disrupt the Service
- Access accounts or data that do not belong to you
- Generate unlawful, abusive, fraudulent, or harmful content
- Attempt to reverse engineer or interfere with the Service
We may suspend or terminate accounts that violate these Terms.
6. Third-Party Integrations
The Service may allow you to connect third-party tools or services.
You are responsible for complying with the terms of those third-party services.
March is not responsible for the operation, availability, or content of third-party services.
7. Fees and Billing
Some features of the Service may require payment.
Payments are processed by Stripe. By subscribing to a paid plan, you authorize us to charge the applicable fees to your selected payment method.
Subscriptions renew automatically unless canceled before the renewal date.
Fees are non-refundable except as required by law.
We may change pricing in the future. If we do, we will provide reasonable notice before new pricing takes effect.
8. Termination
You may stop using the Service at any time.
We may suspend or terminate your access if:
- You violate these Terms
- Your use poses a security or legal risk
- Required by law
Upon termination:
- Your right to use the Service ceases immediately
- You are responsible for exporting any data you wish to retain
Termination does not limit any rights or remedies available to us.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, March disclaims all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
We do not guarantee that the Service will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, March will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
Our total liability for any claim arising out of or relating to the Service will not exceed:
- The amount you paid to March in the 12 months preceding the claim, or
- If you have not paid any fees, $100 USD.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless March from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of:
- Your use of the Service
- Your User Content
- Your violation of these Terms
12. Changes to the Service or Terms
We may update these Terms from time to time.
If we make material changes, we will update the "Last updated" date and post the revised Terms on our Website.
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Arizona.
You consent to the personal jurisdiction of those courts.
